AviaGames sued for dishonest practices

AviaGames Inc. is facing a lawsuit that alleges that the developer has been running an illicit gambling operation that has dishonestly used bots to ensure users can never win real money prizes. 

In a lawsuit perpetrated by some of the company’s main market shareholders, Big Run Studios and Skillz Platform Inc. are demanding compensation.

They claim that AviaGames stole their technology to create their product Bingo Clash, a game virtually identical to their offering Blackout Bingo. 

The Lawsuit

Skillz and Big Run has thus far made this statement:

Avia Games’ actions were to “steal intellectual property and brazenly take and infringe Big Run and Skillz copyrights in some of the most valuable original and creative works ever created for the mobile video game industry”.

Getting into greater detail, this illegal replication of Big Run and Skillz’s product involves the utilisation of bots disguised as real players to cheat users.

This effect has not gone unnoticed either as on multiple occasions furious players have accused Avia of being rigged through excessively low reviews on the AppStore. 

Many players noted that to them it was clear and obvious that they gained significantly lower when playing games where real money was involved.

The lawsuit points out that games of skill are supposed to allow players to compete based on their abilities and explicitly avoid being rigged in favour of the house.

This looks to be an additional branding nightmare as until now AviaGames has attempted to portray itself as a fair and honest gaming platform. 

The lawsuit also takes aim at the company’s founder and CEO, Vickie Chen for recognising this in a Forbes article when she wrote about the necessity of “fairness technology” and “anti-fraud Measures”.

Additional discretions

AviaGames is also accused of copying Skillz’s commercials and using their intellectual property to create rigged games.

Skillz and Big Run Studios are seeking not only compensation but also an injunction to prevent further infringement of their intellectual property.

All in all the lawsuit will see Avia accused of breaching copyright, California’s False Advertising Law, and California’s Unfair Competition Law.
